3. ABOUT LEVEL IX
Level IX Performance & Longevity is a nationwide wellness company that connects patients with licensed independent healthcare providers through a secure telehealth platform.
Level IX:
- Does not practice medicine;
- Does not employ providers as practicing clinicians;
- Does not interfere with medical decision-making;
- Does not guarantee treatment;
- Does not guarantee prescriptions;
- Does not guarantee specific medical outcomes.
All medical decisions—including diagnosis, treatment recommendations, laboratory testing, follow-up care, and prescription decisions—are made solely by licensed healthcare providers exercising their independent professional judgment.

Our Platform may provide access to wellness services including, but not limited to:

5. TELEHEALTH SERVICES
By using our Platform, you acknowledge and consent to receive healthcare services through telehealth technologies where permitted by law.
Telehealth may include:

- Telephone consultations

- Electronic prescribing
- Digital communications
You understand that telehealth has limitations, including potential technological interruptions and that your provider may determine that an in-person evaluation is necessary.
6. INDEPENDENT HEALTHCARE PROVIDERS
Healthcare providers available through the Platform are independent licensed medical professionals.
Providers are solely responsible for:

- Diagnosis
- Determining medical necessity
- Treatment recommendations
- Laboratory orders
- Prescribing medications
- Follow-up care
- Medical record documentation
Level IX does not control or influence these decisions.
7. NO PROVIDER-PATIENT RELATIONSHIP WITH LEVEL IX
Your use of the Platform does not establish a physician-patient or healthcare provider-patient relationship with Level IX.
A provider-patient relationship is established only between you and the licensed healthcare provider after:
- Completion of required medical questionnaires;
- Review of your health information;
- Any required informed consent documents; and
- The provider determines it is appropriate to provide medical care.
8. PRESCRIPTION MEDICATIONS
Certain services offered through the Platform may require a valid prescription.
Prescriptions are issued only when:
- A licensed healthcare provider determines treatment is medically appropriate;
- Applicable federal and state laws are satisfied;
- The provider exercises independent medical judgment.
Submission of a medical questionnaire, payment for services, or consultation does not guarantee that you will receive a prescription.
9. COMPOUNDED MEDICATIONS
Where legally permitted, providers may prescribe compounded medications.
You acknowledge that:
- Compounded medications are prepared by licensed compounding pharmacies.
- Compounded medications are not FDA-approved.
- Compounded medications are prescribed only when determined medically appropriate by your provider.
- Availability varies by state law and pharmacy regulations.
10. PHARMACY SERVICES
If a prescription is issued, it may be transmitted to:
- One of our affiliated licensed pharmacies; or
- Another pharmacy permitted by applicable law.
Pharmacies independently dispense medications and are solely responsible for:
- Dispensing practices;
- Medication fulfillment;
- Shipping;
- Counseling required by law.
Level IX does not manufacture or dispense medications.
11. NO GUARANTEE OF TREATMENT
Use of the Platform does not guarantee:
- Medical treatment;
- Prescriptions;
- Medication availability;
- Laboratory testing;
- Continued treatment;
- Desired results.
Treatment decisions remain solely within the provider’s independent medical judgment.
12. USER RESPONSIBILITIES
You agree to:
- Provide accurate medical information;
- Update information when it changes;
- Disclose medications and allergies;
- Follow provider instructions;
- Use medications only as prescribed;
- Maintain confidentiality of your account credentials;
- Use the Platform lawfully.
Providing false or misleading information may result in denial or termination of services.
13. ACCOUNT SECURITY
If you create an account, you are responsible for:
- Maintaining the confidentiality of your login credentials;
- Restricting access to your devices;
- Promptly notifying us of unauthorized account activity.
You are responsible for all activity occurring under your account.
14. FEES AND PAYMENT
Level IX operates as a cash-pay wellness company.
We do not bill Medicare, Medicaid, or commercial insurance for services unless expressly stated otherwise.
You agree to pay all applicable charges associated with:
- Consultations;
- Laboratory services;
- Medications;
- Memberships (if applicable);
- Wellness programs;
- Shipping;
- Administrative fees.
Payment authorization permits us to charge your selected payment method.
15. REFUNDS
Due to the personalized nature of medical services:
- Consultation fees may be non-refundable.
- Prescription medications generally cannot be returned.
- Compounded medications are generally non-refundable once dispensed.
- Refund eligibility, if any, will be determined in accordance with applicable law and our refund policies.
16. ELECTRONIC COMMUNICATIONS
By using the Platform, you consent to receive communications electronically, including:

- Telephone calls

19. PROHIBITED USES

Level IX is not responsible for services provided by independent third parties.

22. EMERGENCY MEDICAL CARE

Do not rely on electronic communications or telehealth services during an emergency.
23. DISCLAIMER OF WARRANTIES
THE PLATFORM AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEVEL IX DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE PLATFORM WILL OPERATE WITHOUT INTERRUPTION OR ERROR.
24. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEVEL IX, ITS OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, OFFICERS, DIRECTORS, AGENTS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO LEVEL IX FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
25. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Level IX, its affiliates, employees, contractors, officers, directors, agents, providers, and business partners from any claims, damages, liabilities, losses, costs, or expenses arising from:
- Your violation of these Terms;
- Your misuse of the Platform;
- Your violation of applicable law;
- Your negligent or intentional misconduct.
26. ARBITRATION AND CLASS ACTION WAIVER
Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
You agree to waive:
- The right to a jury trial; and
- The right to participate in any class action or representative proceeding.
Nothing in this section limits rights that cannot legally be waived.

30. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Medical Consent Forms, Telehealth Consent, and any additional policies referenced on the Platform, constitute the entire agreement between you and Level IX regarding your use of the Platform and supersede all prior communications relating to the subject matter herein.
